1.4 これからの時代を見据えて

　これからの時代を見据えると、SEが契約書を理解することがより重要になってくることが分かります。コンプライアンスの意識が台頭してきたから、また技術の進歩によって他社技術やオープンソース技術の導入が盛んになってきたからです。

　コンプライアンスの意識が高まってきたということは、皆で決めた決まり事を破ることに対しての世間の認識が厳しくなってきたことです。今までは「なあなあ」で済んでいたことが、これからはきちんと書面に書いてある決まりと同じように進める必要があるということです。違う進め方をして、「今までそうやって来たんだ！」と言っても通らなくなってきたのです。契約というのも決まり事の一種です。そして、法務は契約を守るように啓発する事はできても、実際に契約を守るように行動するのはSEになります。SEが契約書の内容を理解しなくては、コンプライアンスを実行することはできないでしょう。

　また、技術の進歩によって一つの製品に多数の他社技術が搭載されるようになってきました。当初は自社技術だけを搭載していればよかった携帯電話には、IMEをはじめ山のようなアプリケーションが搭載されています。CDの時代にCD-Playerを製作するのに必要だったライセンスの数は、DVD、Bru-rayと世代を経るに従って暗号化方式のみならずコピープロテクション方式など指数関数的に増えていっています。

　プログラムに盛り込むべき機能が多岐に渡りすぎたことから、オープンソースを取り込む動きもあります。しかしながら、オープンソースソフトウェアを商用に利用するには、オープンソースソフトウェアを使用するための条件であるライセンス条件を知り、理解し、実行しなくてはいけません。

　これらの新技術に付随する数々のライセンスの内容を理解し、本当に導入すべき、導入できる技術なのかを決定し、条件があればそれに従うのはSEです。他の部門の人間は製品にどのような技術が搭載されているのか知りません。どれくらい必要な技術であるのかも分かりません。

　また、プログラムのライセンス条件の中には技術の進歩についていけずに時代遅れになっているものもあります。CPU１チップに複数の演算装置を搭載するマルチコアと呼ばれる時代が来ると言われて久しいですが、未だにコンピュータの台数をCPUの数で数え、課金する契約が現役で生きています。CPU換算でお金を払う契約を結んでいる企業にとっては、マルチコア化したときにCPUを1CPUとすべきか2CPUとすべきか、その線引きをどこにすべきかはとても大きな問題です。そして、技術を理解できる人間以外がその線引きを見つけ出すことができるとは思いません。SEが契約内容を理解し、新しい契約の必要性を提案しなければ、契約は旧態依然のまま混乱が生じるでしょう。
